Terms of Service
Welcome to Listd. These Terms are a binding agreement between you and Listd LLC, a Pennsylvania limited liability company (“Listd,” “we,” “us”). By creating an account, posting a listing, sending a message, or otherwise using listdmarket.com or any related apps (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
1. What Listd Is — And Isn't
Listd is a local marketplace platform that lets users post listings to buy, sell, rent, trade, and offer services in their community. Listd is a venue, not a party to any transaction between users. We do not:
- own, possess, inspect, ship, or guarantee any item listed;
- screen users, listings, or messages before they are posted;
- process payments between buyers and sellers, except where you opt in to a paid feature that uses a third-party payment processor (see § 7B below);
- act as a broker, escrow service, agent, fiduciary, or insurer.
You alone are responsible for everything you post, the accuracy of your listings, the legality of items you offer, the people you meet, and any transaction you enter into through Listd.
2. Eligibility
- You must be at least 18 years old to use Listd.
- You must have the legal capacity to enter binding contracts.
- You must not be barred from using the Service under the laws of the United States or your jurisdiction.
- You may only register one account unless we expressly authorize otherwise.
3. Your Account
You are responsible for safeguarding your account and for any activity under it. Notify us immediately at support@listdmarket.com if you suspect unauthorized access. We can suspend or terminate any account at any time, with or without notice, for any reason, including violation of these Terms.
4. Listings and Content
By posting any listing, message, photo, or other content (“Content”) on Listd, you represent that:
- You own the Content or have permission to post it;
- The Content is accurate and not misleading;
- The Content does not infringe any third party’s rights;
- The Content complies with all applicable laws.
You grant Listd a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify (for technical purposes such as resizing photos or generating AI-assisted descriptions), and distribute your Content on and through the Service. This license ends when you delete the Content, except that we may retain copies for backup, legal, or safety purposes for a reasonable period.
5. Prohibited Items and Conduct
The complete, authoritative, and currently enforced list of prohibited items, prohibited conduct, ID/serial requirements, and rental restrictions lives at /prohibited. By creating, editing, or relisting a listing on Listd, you acknowledge and accept the version of that policy in effect at the time you submit the listing. Listd may update the policy at any time; your most recent submission constitutes acceptance of the then-current version. The list below is a high-level summary and does not replace the full policy at /prohibited.
You may not post, sell, offer, request, or message about:
- Illegal drugs, drug paraphernalia, prescription medication, or controlled substances;
- Firearms, ammunition, explosives, fireworks, or weapons regulated under federal or Pennsylvania law (note: Pennsylvania law requires firearm transfers to go through a licensed dealer, so private gun sales are not permitted on Listd);
- Stolen property, counterfeit goods, or anything you don’t lawfully own;
- Human remains, body parts, bodily fluids, or live animals (live animal listings are not permitted at this time);
- Tobacco, vaping products, or alcohol when prohibited by law;
- Hazardous, radioactive, or recalled items;
- Adult sexual content, escort services, or anything that exploits minors;
- Items that infringe trademarks, copyrights, or patents;
- Pyramid schemes, multi-level marketing pitches, or get-rich-quick offers;
- Personal data of others, doxxing, or harassment;
- Spam, scams, phishing, or attempts to move users off-platform for fraud;
- Content that is hateful, harassing, threatening, defamatory, sexually explicit, or that promotes violence against any person or group.
You also agree not to attempt to break, overload, automate, or reverse-engineer the Service, scrape data, send unsolicited messages in bulk, or impersonate anyone.
6. Transactions Between Users
When you arrange a deal with another user, you are entering into a contract with that user directly. Listd is not a party to it and has no liability for it. We strongly recommend:
- Meeting in a well-lit, public place during daylight hours;
- Bringing a friend if possible;
- Inspecting items in person before paying;
- Using cash or instant payment apps only after physical inspection;
- Never wiring money, sending gift cards, or paying in cryptocurrency to strangers;
- Reviewing our Safety Tips before transacting.
7. Paid Features
Listd may offer paid features such as listing boosts, featured placement, or business subscriptions. Pricing and terms for each paid feature will be displayed before purchase. Unless otherwise stated:
- All purchases are final and non-refundable except where required by law;
- Promotional placement does not guarantee a sale, response, or any specific result;
- Subscriptions auto-renew until you cancel; you can cancel at any time;
- We may change prices for future periods with reasonable notice.
7a. Rentals and the Listd Guarantee
Listd lets users offer items for rent. Rentals are between users, just like sales — Listd is still a venue, not a party to your rental agreement, owner, lessor, lessee, or insurer of the item. The full clauses that govern each rental are in the Listd Rental Agreement, which the Renter and Owner both accept at checkout.
- Eligibility to rent. To request a rental as a renter you must have a verified ID, a verified phone number, and an account that is at least 7 days old. Owners may set additional requirements on their listings.
- Pricing and deposit. Owners set daily, weekly, and monthly rates, an optional weekend multiplier, and a refundable security deposit. The total shown at quote time includes Listd’s platform fee, the refundable deposit, and any owner-set price overrides for specific dates. The deposit is held and refunded on clean return; in a dispute, some or all of it may be applied to documented damage or loss.
- Fees. Two fees apply to every completed rental transacted through Listd’s online payments:
- Renter service fee — 8% of the rental subtotal.Added on top of the subtotal and shown at checkout before you confirm. Paid by the renter.
- Owner platform fee — 5% of the rental subtotal.Deducted from the owner’s payout after the rental completes. Paid by the owner.
Listd Guarantee sweep. Approximately 25% of the platform fees Listd collects on rentals accrues into the Listd Guarantee fund described below. The Listd Guarantee is a discretionary goodwill fund and is not insurance. Fees, sweep percentages, and caps may change; the version in force at checkout is the version that applies to that rental.
No-show fee. If a renter fails to appear at the agreed pickup and does not communicate a reasonable alternative, Listd may charge a no-show fee equal to the greater of $5 or 10% of the rental subtotal, retained from amounts already collected, at Listd’s discretion.
Optional damage protection (Listd Protect).Renters may add a Listd Protect tier at checkout for an additional fee. Listd Protect is a discretionary damage protection plan operated by Listd, not an insurance product, and is described in full at /protect. The version in force at checkout is the version that applies to that rental.
- Acceptance and cancellation. A rental request is not binding until the owner accepts it. Either party may cancel before pickup. Once the item is marked picked up, cancellation policies and the dispute process below apply.
- Renter responsibility. You agree to use the rented item only as the owner permits, return it on time in the condition you received it (ordinary wear excepted), and communicate promptly if anything goes wrong. You are responsible for damage, loss, or theft of the item during your rental period.
- Owner responsibility. You agree to provide the item in safe, working condition as described in your listing, honor your accepted bookings, and respond to requests in good faith. You are responsible for confirming the renter’s identity at pickup and for any legal obligations attached to ownership of the item.
- Prohibited rental items. The same prohibited categories that apply to sales (Section 5) apply to rentals. In particular, do not rent firearms, motor vehicles requiring registration, watercraft, aircraft, real property, regulated substances, or any item whose rental requires a license you do not hold.
The Listd Guarantee is not insurance. A small percentage of each completed rental’s subtotal accrues into a discretionary goodwill fund operated by Listd (the “Listd Guarantee”). Payouts from this fund are entirely at Listd’s sole discretion, are not guaranteed, are capped by the available balance, and do not create any insurance relationship, fiduciary duty, or contractual obligation to pay any specific amount. The fund is not:
- an insurance policy, surety bond, or escrow account;
- a substitute for the renter’s or owner’s own insurance, which you are encouraged to maintain;
- available for items, situations, or losses Listd determines in its discretion to be ineligible (including but not limited to wear and tear, pre-existing damage, undocumented claims, late claims, claims arising from prohibited use, claims involving firearms or vehicles, and any loss recoverable from another source).
To request a Listd Guarantee payout, the owner or renter must open a dispute through the rental detail page within 72 hours of return, provide photographs and a written description of the issue, and cooperate with Listd’s review. Listd may capture some or all of the deposit, supplement with a discretionary payout from the fund, decline the claim, or take any other action it considers reasonable. Listd’s decision is final.
Payments. Where Listd offers online payments, we use a third-party payment processor (currently Stripe, Inc.) to handle card capture, transfers to seller / owner accounts, refunds, and dispute resolution. By using a paid feature, you also agree to the processor’s applicable terms (e.g., Stripe Connected Account Agreement and Stripe Services Agreement). Listd does not custody funds and is not a money transmitter, escrow agent, or payment institution. Until online payments are enabled for a given feature, the transaction settles directly between the parties at pickup or as they agree.
7b. SMS Text Messages
When you add and verify a mobile phone number on Listd, you agree to receive transactional and account-related SMS text messages from Listd LLC, including verification codes, new-message alerts, rental and payout notifications, and important account updates.
- Message frequency varies based on your activity on Listd.
- Message and data rates may apply from your carrier.
- Reply STOP at any time to opt out of further messages. Reply HELP for help, or contact support@listdmarket.com.
- Opting out of SMS does not affect your account; you’ll still receive email and in-app alerts.
- Carriers are not liable for delayed or undelivered messages.
- We will never share your mobile number with third parties for their own marketing.
Marketing or promotional SMS, if ever introduced, will be sent only with separate, clearly labeled opt-in, and you can opt out the same way.
7c. Non-Return Protocol
When a rental is not returned by the contracted end date, Listd LLCruns a series of automated reminders to the renter and a documented escalation path for the owner. This section describes the process and what each party can expect.
- Return-window reminders. After the rental end date, Listd LLC sends the renter reminder messages by push, email, and in-app notification at defined intervals asking them to return the item or reach out to the owner.
- Owner filing. If the item still hasn’t been returned after the contracted grace period, the owner can file a non-return report from the rental page. Filing a report begins a 72-hour review window and buzzes Listd LLC’s trust & safety team.
- Renter response pauses escalation. If the renter responds to the owner through the Listd LLC messaging platform during the 72-hour window, the automatic escalation is paused and the case is routed to a human at Listd LLC for review before any further action.
- Confirmation and evidence packet. If the renter does not respond within the review window, the case is confirmed and the owner is issued a Rental Non-Return Evidence Packet (“Owner Copy”) documenting the transaction. The Owner Copy is redacted — it does not include the renter’s full legal name, contact information, or identity- verification session details. The Owner Copy is a factual record of the rental transaction. It is not a legal accusation, does not constitute a determination that a crime has occurred, and is not a substitute for a police report or legal action.
- Owner attestation. Before the Owner Copy is released, the owner must click through an on-screen attestation confirming they will use the packet to file a police report or for direct legal action, and will not distribute the packet publicly or share it with any third party other than law enforcement, their attorney, or their insurer. Distribution outside those channels is a violation of these Terms.
- Suggested Police Report template. After attestation, the owner may also download a suggested police report template pre-filled from the rental facts. The template is provided for the owner’s convenience and is not a sworn statement. The receiving officer decides whether to open a report and what statutory charge, if any, applies.
- Law-enforcement records requests. The renter’s unredacted identity, verification session, and transaction records are released only to a criminal justice agency, and only through Listd LLC’s verified law- enforcement portal at /law-enforcement. Verification includes calling the requesting agency’s published non- emergency line before releasing records. Records may be released in reliance on 18 Pa.C.S. § 9106(c)(4) and equivalent criminal-history-record disclosure rules in other jurisdictions.
- No guarantee of prosecution. Listd LLC does not file police reports on behalf of users, does not initiate criminal or civil actions, and does not guarantee the outcome of any investigation. All statutory and prosecutorial judgment rests with law enforcement.
- False filings. Filing a non-return report you know to be false, submitting a fraudulent law-enforcement request, or misusing a released evidence packet is grounds for immediate suspension of your Listd account, forfeiture of any Listd Guarantee benefit, and may be referred to the appropriate authorities.
8. Reporting and Removal
If you see a listing, message, or user that violates these Terms or the law, report it through the in-app report button or email support@listdmarket.com. We may remove any Content and suspend any user at our sole discretion. We’re a small team — please be patient, but we take genuine safety reports seriously.
9. Copyright (DMCA)
Listd respects intellectual property rights and responds to notices of alleged infringement consistent with the Digital Millennium Copyright Act (17 U.S.C. § 512).

To submit a takedown notice, email our designated agent a notice containing:
- Identification of the copyrighted work;
- The URL of the allegedly infringing material on Listd;
- Your contact information;
- A statement that you have a good-faith belief the use is not authorized;
- A statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf;
- Your physical or electronic signature.
Counter-notification. If your content was removed and you believe the removal was in error, you may submit a counter-notice to our designated agent including (i) your contact info and physical or electronic signature, (ii) identification of the removed material and where it appeared, (iii) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and (iv) consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the U.S., the Commonwealth of Pennsylvania), and that you will accept service from the original complainant.
Repeat infringer policy. We terminate accounts of users we determine, in our reasonable discretion, to be repeat infringers.
9a. Child Safety / CSAM Reporting
Posting, transmitting, or soliciting child sexual abuse material (CSAM) or any sexual content involving minors is strictly prohibited and grounds for immediate, permanent ban.
Consistent with 18 U.S.C. § 2258A, Listd reports apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and cooperates with law enforcement. If you encounter such content on Listd, report it immediately to support@listdmarket.comand, if appropriate, directly to NCMEC at report.cybertip.org.
9b. Fair Housing
Housing-related listings (including room rentals, sublets, and short-term rentals) must comply with the federal Fair Housing Act, 42 U.S.C. § 3601 et seq., and applicable state and local fair housing laws. You may not publish any listing or message that expresses a preference, limitation, or discrimination based on race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, or disability, or that violates other protected-class rules in your jurisdiction.
Listd may remove housing-related Content that appears to violate these laws and may terminate accounts that repeatedly do so. You are solely responsible for your housing listings and any compliance obligations applicable to landlords, sublessors, or hosts in your area.
9c. Taxes
You are solely responsible for determining and paying any federal, state, or local taxes (including income, self-employment, and sales/use tax) arising from your activity on Listd.
Where Listd processes payments on your behalf (for example, rentals or future payment features), our payments partner (currently Stripe) may issue you a Form 1099-K or other tax reporting form when thresholds apply, and you agree to provide accurate taxpayer information when requested. Listd does not provide tax advice. Consult a qualified tax professional regarding your obligations.
9d. Vehicles, Titles, and Bill of Sale
Vehicle, trailer, boat, ATV, and other titled-asset listings have additional rules:
- You represent that you are the legal owner or otherwise authorized to sell the vehicle, that any title in your name is valid and unencumbered (or that you have disclosed any liens), and that the VIN you provide matches the title and the vehicle.
- You are solely responsible for transferring title, completing any state-required Bill of Sale, paying transfer taxes, and cancelling registration/insurance per the laws of your state (in Pennsylvania, see the PA Department of Transportation (PennDOT) Form MV-4ST and related guidance).
- Listd does not verify titles, VINs, mileage, or accident history. Any vehicle history information surfaced through Listd is provided by third parties for convenience and may be incomplete or inaccurate.
- Curbstoning (selling vehicles you do not own, or selling more vehicles than your state permits without a dealer license) is prohibited and may violate state law.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Listd does not warrant the identity, legitimacy, or behavior of any user, the existence or condition of any item listed, the truth of any statement made by users, or that any transaction will be completed. You use Listd at your own risk.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LISTD AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, ANY USER, OR ANY TRANSACTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID LISTD IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Listd and its owners, officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your Content, (c) your violation of these Terms, or (d) your violation of any law or any third party’s rights.
13. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally must be brought in the state or federal courts located in the Commonwealth of Pennsylvania, and you and Listd consent to the personal jurisdiction of those courts. Both parties waive any right to a jury trial.
14. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we’ll let you know by email or a notice on the Service at least 7 days before it takes effect. Continued use of the Service after the change means you accept the new Terms.
15. Termination
You can stop using the Service at any time by deleting your account from your account page. We can suspend or terminate your account at any time for any reason. Sections that by their nature should survive termination — including content licenses for residual copies, disclaimers, limitation of liability, indemnification, and governing law — will survive.
