Listd Rental Agreement
This is the agreement between the Renter and the Owner of an item rented through Listd. Listd is not a party to the rental — we’re a venue that connects Renter and Owner, processes payment, and applies the fee and protection structure described below.

1. What you\u2019re agreeing to
When the Owner accepts a rental request and the Renter completes checkout, both parties agree to this Rental Agreement, Listd’s Terms of Service, the Prohibited Items policy, and (if selected) the Listd Protect tier shown at checkout.
The version of this agreement in force at the moment the Renter confirms payment is the version that governs the rental. Version stamped: 2026-07-03.v1.
2. Fees
- Renter service fee — 8% of the rental subtotal. Added on top of the subtotal at checkout. Non-refundable once the rental is confirmed except at Listd’s discretion.
- Owner platform fee — 5% of the rental subtotal. Deducted from the Owner’s payout after the rental completes.
- Listd Guarantee sweep — approximately 25% of platform fees accrues into the discretionary Listd Guarantee fund. The Listd Guarantee is not insurance.
- No-show fee — the greater of $5 or 10% of the rental subtotal. Charged if the Renter fails to appear at pickup and does not communicate a reasonable alternative.
- Optional Listd Protect fee — the tier selected at checkout, if any. Paid by the Renter, retained by Listd. See /protect.
3. Security deposit
The Owner sets a refundable security deposit at listing time. Listd captures the deposit at checkout and holds it during the rental period.
- Clean return. When the Owner confirms clean return, the deposit is released back to the Renter within a few business days (bank processing times apply).
- Damage or loss. If the Owner documents damage or loss within 72 hours of the rental’s scheduled end date, Listd may apply some or all of the deposit toward the Owner’s documented loss. The remainder returns to the Renter.
- Non-return. If the Renter fails to return the item after the scheduled end date, the Owner may open a non-return case. Listd may transfer the deposit to the Owner after the internal resolution described in Section 6.
4. Renter obligations
- Use the item only as the Owner permits at pickup and only as its manufacturer intended.
- Return the item at the agreed date and place in the condition received, ordinary wear excepted.
- Communicate promptly via Listd messaging if anything goes wrong.
- Do not sub-lease, transfer, or take the item across state lines without the Owner’s written consent (through Listd messaging).
- You are responsible for damage, loss, or theft of the item during your rental period, subject to any Listd Protect tier you selected.
5. Owner obligations
- Provide the item in safe, working condition as described in the listing.
- Honor your accepted bookings.
- Confirm the Renter’s identity at pickup (Listd surfaces the Renter’s verified identity in the app).
- Document the item’s pre-rental condition (photos in the app or an equivalent written note) if you plan to make a damage claim later.
- Respond in good faith to Listd’s dispute review.
6. Disputes and non-return
If a rental doesn’t go smoothly, both parties should first try to resolve it through Listd’s in-app messaging.
If that fails, the Owner or Renter may open a case through the rental detail page. Listd will review the case, request documentation from both sides, and issue a discretionary resolution — which may include releasing the deposit, capturing some or all of the deposit, applying a Listd Protect payout (if the Renter selected a tier), applying a discretionary goodwill payout from the Listd Guarantee fund, or declining the claim.
Non-return protocol. If the Renter has not returned the item within 72 hours of the scheduled end date, the Owner may open a non-return case. Listd will attempt to contact the Renter, extend the timeline where reasonable, and if the Renter remains unresponsive, may transfer the deposit to the Owner and generate a Rental Non-Return Evidence Packet that the Owner may use to file a report with local law enforcement. The Evidence Packet documents the transaction and communications on the Listd platform; it does not constitute a legal determination by Listd that a crime has occurred. Listd will release additional records, including participants’ full identity information, to law enforcement upon request via verified agency channel or legal process. The packet is provided as-is and does not commit Listd to any specific enforcement action.
Listd’s decision on any dispute is final between Listd and the party filing the claim. Renter and Owner remain free to pursue civil remedies against each other independently.
7. Assumption of risk
Renting physical items involves inherent risk of injury, property damage, and financial loss. By renting through Listd, both parties acknowledge that Listd does not inspect items, does not train Renters, does not carry insurance on rented items on the Renter’s or Owner’s behalf, and cannot guarantee the safety, fitness, or performance of any item.
The Renter operates the rented item at their own risk. The Owner represents that they own the item, have the right to rent it, and have disclosed material defects and safety information known to them. Neither party may pass responsibility for their own negligence to Listd.
8. Indemnification
Renter and Owner each agree to indemnify and hold harmless Listd LLC, its officers, employees, and contractors from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of the rented item, the rental period, or either party’s breach of this Agreement, except to the extent caused by Listd’s own gross negligence or willful misconduct.
9. Dispute resolution between Listd and either party
Any dispute between Listd and the Renter or the Owner arising out of this Rental Agreement is subject to the arbitration and venue provisions of the Terms of Service. Nothing in this Agreement waives the right to bring an individual claim in small-claims court.
10. Changes to this Agreement
Listd may update this Rental Agreement from time to time. The version in force at the moment the Renter confirms payment governs that rental for its full lifecycle — later edits do not retroactively apply. Listd bumps AGREEMENT_VERSION whenever it materially changes the Renter or Owner’s rights.
